Marshall MO family recovers proceeds from multiple insurance policies
Lear Werts LLP represented the family of a young woman who tragically died from injuries she sustained in a car crash when the driver of the car lost control and the vehicle struck a tree.
Wrongful death car crash case
In this case, there were issues over what insurance policy provided coverage for the car accident. Ultimately, Lear Werts was able to recover from both the insurance company of the driver and the car dealership that owned the car. This case required the attorneys in our law firm to file a wrongful death lawsuit in the Saline County Circuit Court in Marshall, Missouri. The case was transferred to the Lafayette County Circuit Court in Lexington, Missouri. The case was resolved for a policy-limit settlement prior to trial.
Our law firm also defended a declaratory judgment action filed by the driver’s insurance company. That insurance company had denied that the car insurance policy they had issued provided coverage. That case was negotiated to a settlement after trial.

Marshall is the county seat of Saline County, Missouri and is located approximately one-third of the distance between Columbia and Kansas City, Missouri. Interstate 70 (I-70) and U.S. Highway 65 (Hwy. 65) intersect in Saline County, meeting approximately 15 miles south of Marshall.
