Operations Center Employees Sue State Farm Over Unpaid Overtime

Lear Werts LLP and our co-counsel Stueve Siegel Hanson, LLP have filed a class action lawsuit for unpaid wages and overtime on behalf of telephone-dedicated employees who worked in any of State Farm’s Operations Centers nationwide.

Summary of Lawsuit

We represent employees who have worked in a call center environment (including, but not limited to, Claims Processors, Claims Representatives, and Customer Service Representatives) in a wage and hour class action case against State Farm Mutual Automobile Insurance Company. The case is filed as Lisa Nobles, individually and on behalf of a class of others similarly situated v. State Farm Mutual Insurance Company and is pending in the Central Division of the Western District of Missouri as Case No. 2:10-cv-04175-NKL before the Honorable U.S. District Judge Nanette Laughrey.

The lawsuit alleges that State Farm consistently violated wage and hour laws by failing to accurately record all time worked and failing to pay required overtime to employees at its Operations Centers around the country. The lawsuit alleges that State Farm required employees to work "off the clock" by not paying for work performed pre-shift and over unpaid meal breaks. These tasks included such activities as logging into the computers, opening relevant computer programs, reviewing company memoranda, email, and notices, and completing other tasks related to their jobs. The workers are seeking collective action status.
