Call Center Employees Sue APAC Over Unpaid Overtime

Lear Werts LLP and our co-counsel Stueve Siegel Hanson, LLP have filed a class action lawsuit on behalf of APAC call center employees for unpaid wages and overtime.

Summary of Lawsuit

We represent call center employees in a wage and hour class action case against APAC. The case is filed as Tiffany Sharpe, individually and on behalf of a class of others similarly situated v. APAC Customer Services, Inc. and is pending in the Western District of Wisconsin as Case No. 09CV329.

The lawsuit alleges that APAC consistently violates federal and Wisconsin overtime laws by failing to accurately record all time worked and failing to pay required overtime to employees at its call centers around the country. The lawsuit alleges that APAC requires employees to work "off the clock" by not paying for work performed pre-shift, post-shift, and over unpaid meal breaks. These tasks include such activities as booting up computers, logging on to APAC's intranet, opening relevant computer programs, reviewing company memoranda and notices, and completing other essential tasks. The workers are seeking collective action status.

We are investigating APAC's compensation practices at its call centers located in La Crosse, Wisconsin; Tucson, Arizona; Davenport, Iowa; Shaumburg, Illinois; Green Bay, Wisconsin; Wilmington, North Carolina; Cedar Rapids, Iowa; Tampa, Florida; Newport News, Virginia; Corpus Christi, Texas; and Utica, New York.
